Terms and Conditions

1.1 Kandu means the persons responsible for organising, in each individual case, the contracted Trip and any other person engaged by Kandu to assist in the Trip.

1.2. Participant means the person for whom Kandu has agreed to provide the Trip. Restrictions may apply depending on the age and physical condition of the person. Please contact us in case of doubt.

1.3 Trip means the Maldives trip to be provided by Kandu as described and detailed in the Trip Programme.

1.4 Trip Cost means the total price of the Trip as described in the Maldives Trip Programme.

Definitions

2.1 Kandu will provide the Trip using reasonable skill and care.

2.2 Where any part of the Trip is provided by any third party, Kandu will use reasonable skill and care in selecting such other third party but shall not be liable to the participant for the performance of the third party and/or for any loss or damage, whether of a personal nature or to the participant’s possessions, caused by the third party.

2.3 The Trip by its very nature has inherent risks which the participant recognises and accepts in joining the Trip.

2.4 The Participant travels and takes part in the Trip entirely at his own risk and Kandu shall not be liable to the participant by reason of any representation or implied warranty, condition or other term, or any duty, in contract or law, for any loss of profit or any consequential loss of any kind howsoever caused and whether caused by Kandu or any other party engaged by Kandu to assist in the Trip.

2.5 Kandu gives no warranty as to the ultimate success or otherwise of the Trip as this can be dependent upon numerous external factors, such as weather or sea conditions, over which Kandu has no control.

2.6 Kandu shall not be liable for any delay to or cancellation of the Trip due to any reasons beyond its control, or for any damage to the participant’s property howsoever caused.

2.7 The liability of Kandu to the Participant is limited to the Trip Cost.

Liability

3.1 The Participant agrees to take out adequate insurance at his own expense to cover all risks associated with the Trip and will provide a copy of his/her insurance policy as evidence to Kandu that such insurance has been taken out by him/her for the Trip.

3.2 The Participant is recommended to take out cancellation insurance upon payment of the deposit.

3.3 The Participant shall be fully responsible for ensuring that the insurance taken out by him/her covers all the risks which the participant, at their sole discretion, considers are necessary to be covered in respect of the Trip.

Insurance

4.1 The Participant shall pay the Trip Cost to Kandu.

4.2 A deposit, for the amount of 40% of the Trip Cost shall be paid at the time of booking, once Kandu has confirmed to the Participant that there is a place available, as the number of Participants is limited.

4.3 The Trip Cost includes elements, such as fuel, that are subject to significant variations. If the cost of fuel changes by more than ± 10%, then Kandu reserves the right to amend the cost accordingly.

4.4 Payment of the final balance of the Kandu Cost shall be paid at arrival.

Payments

5.1 In the event of the Participant cancelling and/or withdrawing from the Trip, for which notice must be given in written form; either by email or WhatsApp, for any reason whatsoever (except cancellation by Kandu), the following will apply: ​

  • (i) If the Participant cancels or withdraws at any time before the Trip start date, then no refund of the deposit paid will be given. Upon revision, if the circumstance applies, a voucher for the monies paid can be given to the Participant for future use.

Cancellation Policy

6.1 Kandu reserves the right to make changes to the itinerary of the Trip if this becomes necessary for any reason.

6.2 These terms and conditions and the signed disclaimer together represent the entire agreement between the parties and may not be varied except in writing between the parties.

6.3 Should any part of these terms and conditions and the disclaimer be held unenforceable in law then that part may be omitted, and the rest of the terms and conditions and the disclaimer shall still apply.

6.4 All services provided by Kandu to the Participant are to be supplied exclusively in the Maldives. The applicable law will be Maldives Law and the Maldives Courts shall have exclusive jurisdiction regarding any dispute herewith related.
